Principles of protection of personal and other processed data

On this page you will find a summary of how Mellien sro works with personal data and the main principles of protecting your personal data and other processed data in accordance with the GDPR.

What is GDPR?

GDPR, or General Data Protection Regulation, will come into effect on May 25, 2018 and represents a new legal framework for personal data protection in the European area with the aim of protecting as many rights of EU citizens as possible against the unauthorized processing of their data, including personal data. GDPR applies to all companies and institutions, as well as individuals and online services that process user data.

Who processes your data?

The controller of your personal data will be the company Mellien sro Lánecká 316, Světlá nad Sázavou, Czech Republic, identification number: 23108657 entered in the commercial register kept by the Regional Court in Hradec Králové C 54482. This data will be processed by the company (Controller) in accordance with the conditions set out below. The Controller can be contacted by e-mail at info@mellien.com

What personal data do we process about you?

We only process the personal data that you provide to us in connection with the use of our services (for example, subscribing to the newsletter or ordering goods), or concluding a purchase contract in the case of purchasing our goods. This is the data that you provide to us when registering for one of our services:

• e-mail,
• first and last name (if you provide it to us when ordering),
• contact and/or delivery address (for the purpose of delivering the ordered goods),
• telephone number (for the purpose of delivering the ordered goods or informing about the status of the order),
• payment details (payment card number) stored in your account (only when making a purchase in our e-shop),
• other data that you voluntarily fill in, for example in the contact form,

and the data we collect from you using our website:

• IP address,
• cookies (in the case of online services),
• or another online identifier.

Why we process your personal data

We process your personal data mainly for the following reasons:

• so that we can provide you with the services you have expressed interest in (ordering goods or purchasing them in the e-shop, sending a newsletter),
• to improve the quality of our services and possibly add new services in which you are interested,
• to analyze and measure interest in our services and products,
• so that we can analyze your preferences and display content that really interests you,
• to gain advantages in organizing our marketing campaigns,
• so that we can send you commercial communications in the form of newsletters, in which you will find invitations to events we organize, information about news or special offers; you can easily unsubscribe from them directly by clicking the “unsubscribe” button in the newsletter, or by e-mail to info@mellien.cz,
• so that we can answer your questions sent via our contact forms.

By consenting to the processing of your personal data, we can continue to provide you with these services.

Who has access to your data?

Your personal data is safe with us. We only work with partners who are demonstrably trustworthy and who are able to guarantee the security of your personal data. None of our partners may use your personal data for purposes other than those described in this policy, nor may they provide it to anyone else.

Third parties that may have access to your personal data are:

• persons to whom we provide data for the purpose of analyzing traffic to our websites,
• persons who ensure the technical operation of certain services for us or operators of technologies that we use for our services,
• persons who ensure sufficient security and integrity of our services and websites for us and also regularly test this security,
• payment gateway providers (payment card providers) in the case of online payments,
• shipping service providers who deliver your orders to you,
• operators of technical solutions, thanks to which we can only display content and advertising that is relevant to you.

Under certain legal conditions, we are obliged to transfer some of your personal data based on valid legal regulations, for example to the Police of the Czech Republic, or to other authorities involved in criminal proceedings, including specialized departments and other public administration authorities.

What are cookies and what types do we use?

Like all other websites, the website uses  www. Mellien.com cookies. These are text files containing a small amount of information that is downloaded to your computer, mobile phone or other device when you visit a website. Each time you visit this website, the cookies are then sent back to the original website or to another website that recognizes them. Your person is not identifiable based on this information, even using other information we have about you. This includes, for example, information about the type of device and browser used, language preferences or the pages that have been visited. Thanks to them, you are also shown advertising for products that match your personal interests and preferences. Cookies are not dangerous, they are not used to obtain any sensitive personal data, but they are important for privacy protection. We do not use cookies to identify website users or to misuse login details. We use cookies to recognize repeat visits to our website. We collect cookie information on our website to better track the number of new and repeat visitors and for internal analysis of the pages visited. We use this information to improve navigation on our website and the services provided. Another group is third-party cookies (e.g. Google Analytics for analyzing traffic to a specific website or certain services or cookies from advertising system operators that are operated on our website). These cookies are controlled by third parties and we do not have access to read or write this data.

How long do we process your data?

We will process your data for the entire period of use of our services (i.e. the duration of the contractual relationship between us) and subsequently, based on your consent, for a further 3 years, unless your consent to the processing of personal data is revoked by you. We are required by law to store your billing data for a period of 5 years.

Can we process your personal data without your consent?

Yes, we may process your personal data without your consent, but only for the purpose of:

• provision of a service or product (fulfillment of a contract concluded between you and us, whereby the actual use of a certain service is also a contract without the need to sign anything);
• fulfillment of legal obligations that arise for us from generally binding legal regulations (e.g. we are obliged to store operational and location data pursuant to Act No. 127/2005 Coll., on electronic communications); or
• processing that is necessary for the purposes of our legitimate interests (e.g. for direct marketing, ensuring the security of our websites). The possibility and legality of such processing results directly from applicable legal regulations and your consent to this processing is not required.

On what basis do we process your personal data?

We may process your personal data:

• based on your consent,
• based on our legitimate interest (in particular processing for direct marketing purposes),
• for the fulfillment of the contract concluded between us, to the extent of personal data that is necessary for such fulfillment,
• due to the fulfillment of obligations that arise for us from the law.

Securing your personal data

All personal data you provide to us is secured using standard procedures and technologies. We regularly check our system and use security measures to prevent, as far as possible, unauthorized access to your personal data, which provide sufficient security considering the current state of technology. In order to better secure your personal data, access to this data is password protected and sensitive data is encrypted during transmission between your browser and our website.

Withdrawal of consent to the processing of your personal data

You can withdraw your voluntarily given consent to the processing of personal data at any time free of charge by sending an e-mail to: info@mellien.com. Withdrawal of consent does not affect the possibility of continuing to process your personal data based on your consent given before its withdrawal. Withdrawal of consent also does not affect the processing of personal data that we process on a legal basis other than consent (i.e. in particular if the processing is necessary for the performance of a contract, a legal obligation or for other reasons specified in applicable law).

Am I obliged to provide my personal data? What if I do not provide personal data?

You provide us with your personal data voluntarily. Their processing, often only in anonymized form, without us being able to identify you as a specific user, allows us to provide you with our services and to continuously improve them. If you do not give us your consent or revoke it subsequently, it may happen that we will no longer be able to provide you with some of our services, or that we will not be able to provide you with them in full or in good quality. However, you are not obliged to use our free services.

Your rights regarding the protection of personal data

In relation to your personal data, you have in particular the following rights:

• the right to withdraw your consent at any time,
• the right to correct or supplement personal data,
• the right to request restriction of processing,
• the right to object or complain to processing in certain cases,
• the right to request data portability,
• the right to access personal data,
• the right to be informed of a personal data breach in certain cases,
• the right to erasure of personal data (the right to be “forgotten”) in certain cases
• and other rights set out in the Personal Data Protection Act and in the General Data Protection Regulation No. 2016/679 after its entry into force.
